Welcome to Dose Cacao.
These Terms of Service apply when you access our website, purchase from us, interact with our online store, or use any information, content, features, tools, products or services made available by Dose Cacao.
In these Terms, “Dose Cacao”, “Dose”, “we”, “us” and “our” refer to Dose Cacao. “You” and “your” refer to any customer, visitor or user of our website or services.
Our website is powered by Shopify, which provides the ecommerce platform we use to sell our products.
By visiting our website, placing an order, or using our services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you should not use our website or purchase from us.
1. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any right, remedy, guarantee or protection you may have under the Australian Consumer Law or any other applicable law that cannot legally be excluded, restricted or modified.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You may be entitled to a replacement, refund, repair or other remedy if a product fails to meet a consumer guarantee.
Consumer guarantees are automatic and cannot be taken away by business terms, policies or warranties. The ACCC confirms that consumer guarantees apply automatically and cannot be excluded.
2. Eligibility and account use
By using our website or placing an order, you confirm that you are at least 18 years old, or that you are using the website with the consent and supervision of a parent or guardian.
You agree to provide accurate, complete and current information when placing an order, creating an account or contacting us.
If you create an account, you are responsible for keeping your login details secure and for all activity that occurs under your account. You must not transfer, sell or assign your account to another person.
3. Our products
Dose Cacao sells cacao-based food products for beverages and related goods.
We make reasonable efforts to describe and display our products accurately. However, product images, colours, packaging and appearance may vary depending on your screen, device settings, production batch, packaging availability and the natural characteristics of cacao.
Because cacao is a natural food product, there may be natural variation in colour, aroma, texture, finish, shape and appearance. Minor surface marks, colour changes or cacao bloom may occur and do not necessarily mean the product is unsafe or faulty.
Product descriptions, ingredients, prices, packaging and availability may change from time to time without notice.
We reserve the right to discontinue any product, limit quantities, or refuse supply where reasonably necessary.
4. Food, ingredients and allergens
Our products are food products. You are responsible for reading all product information, ingredient lists, allergen information and storage instructions before purchase and consumption.
Although we take reasonable care with product information, you should not rely on website imagery or general marketing content alone when assessing whether a product is suitable for you.
Unless expressly stated otherwise, our products may be manufactured, handled, packed or stored in environments where allergens may be present.
If you have allergies, intolerances, medical conditions, dietary restrictions, are pregnant or breastfeeding, or are unsure whether a product is suitable for you, you should seek advice from a qualified health professional before consuming our products.
5. No medical or therapeutic advice
Any information on our website, packaging, emails, social media or other content is provided for general information only.
Our content is not medical advice, nutritional advice, therapeutic advice or a substitute for advice from a qualified health professional.
We do not claim that our products diagnose, treat, cure or prevent any disease, condition, illness or health concern.
Any references to rituals, wellbeing, mood, focus, calm, energy, minerals, cacao benefits or lifestyle routines are general in nature and should not be relied on as medical or therapeutic claims.
6. Orders
When you place an order through our website, you are making an offer to purchase the products in your cart.
An order is not accepted until we confirm acceptance, process payment and issue an order confirmation.
We may accept, decline, cancel or limit an order where reasonably necessary, including where:
- a product is unavailable;
- payment cannot be processed;
- there is an error in pricing, product information or availability;
- we suspect fraud, misuse or unauthorised activity;
- delivery is not available to your location;
- the order appears to be for commercial resale without our consent.
If we cancel an order after payment has been taken, we will provide a refund for the cancelled item or order, unless otherwise permitted by law.
Please review your order carefully before submitting it. Once an order has been placed, we may not be able to make changes or cancel it before dispatch.
7. Pricing and payment
All prices are listed in Australian dollars unless stated otherwise.
Prices are subject to change without notice. The price charged for a product will be the price displayed at the time you place your order, subject to any obvious error.
Shipping, handling, taxes or other charges may be added at checkout where applicable.
You agree to provide accurate and current payment, billing and contact information. You confirm that you are authorised to use the payment method provided.
Payments are processed by third-party payment providers, such as Shopify Payments, PayPal, Afterpay or other payment services we may offer. Those providers may have their own terms and privacy policies.
8. Promotions and discount codes
From time to time, we may offer promotions, discounts, bundles, gifts with purchase or other offers.
Promotions may be subject to additional terms, expiry dates, minimum spend requirements, exclusions or stock availability.
We may modify, suspend or end promotions at any time, unless doing so would breach applicable law.
Discount codes cannot be exchanged for cash and may not be applied retrospectively unless we choose to do so.
9. Shipping and delivery
We will make reasonable efforts to process and dispatch orders within the timeframes stated on our website. Delivery times are estimates only and are not guaranteed.
We are not responsible for delays caused by events outside our reasonable control, including courier delays, postal delays, weather events, customs processes, public holidays, incorrect delivery information, system outages or other external disruptions.
You are responsible for providing accurate shipping information. If an order is delayed, lost or returned because you provided incorrect or incomplete delivery details, we may require you to pay additional shipping costs to resend the order.
Nothing in this section limits any rights you may have under the Australian Consumer Law, including where goods are not supplied, are damaged, or fail to meet a consumer guarantee.
10. Heat-sensitive products
Some of our products are heat-sensitive and may be affected by temperature, humidity, handling, transport and storage conditions.
Cacao and chocolate-style products may naturally develop bloom, including light marks, streaks, dullness, white or greyish coating, surface spotting, texture changes or changes in snap and finish. Bloom can occur when cacao butter or sugar crystals move to the surface due to temperature changes, humidity, storage conditions or handling during delivery.
Bloom is generally a cosmetic or texture-related change and does not necessarily mean the product is unsafe, faulty or unsuitable for consumption.
We take reasonable care when preparing, packing and dispatching our products. However, once an order is in transit, we cannot control delivery conditions, courier handling, time spent in vehicles, parcel lockers, mailboxes, depots, doorsteps, warm rooms or other environments.
You are responsible for collecting your order promptly after delivery and storing it in accordance with the instructions provided on our website, packaging or product information.
We recommend storing Dose Cacao products in a cool, dry place away from direct sunlight, heat, moisture and strong odours. Do not leave products in a hot car, mailbox, parcel locker, direct sunlight or other warm environment.
Where appropriate, we may adjust dispatch days, use protective packaging, delay dispatch during extreme weather, or recommend certain shipping options. However, we do not guarantee that products will arrive without bloom, softening, marking or other heat-related changes.
If your product arrives severely melted, damaged, leaking, contaminated, incorrectly supplied, or otherwise not as described, please contact us promptly with your order number and clear photos so we can assess the issue.
Nothing in this section limits any rights you may have under the Australian Consumer Law.
11. Returns, refunds and exchanges
Returns, refunds and exchanges are handled in accordance with our Refund Policy.
Due to the nature of food products, we may not accept returns or exchanges for change of mind, especially where products have been opened, used, damaged, improperly stored or are no longer in saleable condition.
However, nothing in our Refund Policy or these Terms limits your rights under the Australian Consumer Law. You may be entitled to a remedy if a product is faulty, unsafe, not as described, not of acceptable quality, or otherwise fails to meet a consumer guarantee.
The ACCC states that consumer guarantees are automatic and are separate from warranties. The ACCC also provides mandatory wording for goods supplied in Australia, including that goods come with guarantees that cannot be excluded under the Australian Consumer Law.
12. Website information
The information on our website is provided for general information only. We make reasonable efforts to keep information accurate and up to date, but we do not guarantee that all information will always be complete, current or error-free.
We may correct errors, inaccuracies or omissions at any time, including after an order has been submitted.
This may include errors relating to product descriptions, pricing, promotions, shipping charges, delivery times, product availability or other content.
13. Intellectual property
All content on our website, including text, images, graphics, logos, product names, designs, branding, product descriptions, photographs, videos, icons and layout, is owned by or licensed to Dose Cacao, unless stated otherwise.
You may access and use our website for personal, non-commercial use only.
You must not copy, reproduce, modify, distribute, publish, display, sell, license, scrape, extract, exploit or use any part of our website or content without our prior written consent.
The Dose Cacao name, logo, product names, slogans, designs and branding must not be used without our written permission.

If you submit reviews, comments, photos, feedback, suggestions or other content to us, you confirm that:
- the content is accurate and not misleading;
- you own or have permission to provide the content;
- the content does not infringe another person’s rights;
- the content is not unlawful, abusive, defamatory, obscene or harmful.
By submitting content to us, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, edit, publish, display and share that content for business, marketing, promotional, product development and customer service purposes.
We may remove, edit or refuse to publish user content at our discretion.

Our store is powered by Shopify, which enables us to provide our online store and related services.
Any purchases you make through our store are made directly with Dose Cacao, not Shopify.
By using our website, you acknowledge that Shopify is not responsible for any aspect of your purchase from us, including the products sold, fulfilment, customer service, product issues, refunds, damage, injury or loss relating to products purchased from Dose Cacao.

Your use of our website is also governed by our Privacy Policy.
Our Privacy Policy explains how we collect, use, store and disclose personal information, including information processed through Shopify and other service providers.
You should read our Privacy Policy before using our website or purchasing from us.
18. Prohibited uses

You agree to indemnify Dose Cacao and our officers, employees, contractors, service providers and partners against any loss, damage, liability, claim, cost or expense arising from:

- your misuse of our website or services;
- your violation of any law or third-party right;
- any content or information you provide to us;
- your unauthorised use of our intellectual property.
This indemnity does not limit your rights under the Australian Consumer Law.

We are not responsible for delays or failures caused by events outside our reasonable control.
This may include natural disasters, extreme weather, transport disruptions, courier delays, strikes, supply chain issues, system outages, cyber incidents, government restrictions, pandemics, public health events or other events beyond our reasonable control.

We may update these Terms from time to time to reflect changes to our business, website, products, services, legal obligations or operating practices.
The updated Terms will be published on our website with the “Last updated” date shown at the top.
Your continued use of our website after changes are published means you accept the updated Terms.
24. Severability
If any part of these Terms is found to be invalid, unlawful or unenforceable, that part will be read down or removed to the extent necessary, and the remaining sections will continue to apply.
25. No waiver
If we do not immediately enforce a right under these Terms, that does not mean we waive that right.
Any waiver must be in writing and signed by us.
26. Governing law
These Terms are governed by the laws of Queensland, Australia, and applicable Australian federal laws.
You and Dose Cacao agree to submit to the courts of Queensland, Australia, and any courts entitled to hear appeals from those courts.
